Spectacom Global Private Limited is a company registered in India under the Companies Act, 2013, having its registered office at 809 Udyog Vihar, Phase V, Gurugram (Haryana) – 122016 (referred to as “SGPL”, “we” or “us”) in these Terms and Conditions (“T&Cs”). The terms “you”, “your” or “User” refer to all individuals and/or entities browsing, accessing or using the mobile application and/or the SGPL website www.devilscircuit.com (collectively referred to as the “SGPL Platform”), for understanding our Services (as defined hereinafter) or obtaining information regarding the same, and/or for participating in SGPL events.
By accessing and interacting on the SGPL Platform, you agree to be bound by these T&Cs, which form a binding agreement between you and SGPL. Please familiarise yourself with our T&Cs, Privacy Policy, and any other terms and conditions published on the SGPL Platform, including any event-specific registration or waiver form (collectively, “SGPL Policies”) before you use the SGPL Platform. If you do not agree with any provision of the SGPL Policies, please do not use or access the SGPL Platform.
We may, from time to time, change the SGPL Policies that govern your use of the SGPL Platform. Please check the SGPL Policies periodically to stay informed of the terms that apply at that time. We reserve the right to change the format or content of the SGPL Platform, or suspend its operation for maintenance or any other reason, at our discretion.
1. ELIGIBILITY AND MINORS
Only persons who can enter into legally binding contracts under the Indian Contract Act, 1872, i.e., persons who are 18 (eighteen) years of age or older, of sound mind, and not otherwise disqualified from contracting under Applicable Law, may register an account, purchase a Product, or directly accept these T&Cs on the SGPL Platform.
If you are under the age of 18 (eighteen) years (a “Minor”), you are prohibited from directly creating an account, registering for an event, or purchasing a Product on the SGPL Platform. A Minor may access the SGPL Platform and participate in our Services only through a parent or lawful guardian who is of legal age to form a binding contract under the Indian Contract Act, 1872. Such parent or lawful guardian shall (a) execute these T&Cs, the applicable event waiver, and any associated SGPL Policies on behalf of the Minor; (b) be treated as the contracting party for all purposes under these T&Cs; and (c) assume full legal and financial responsibility for the Minor’s registration, participation, and conduct.
Where we become aware that a Minor is using or has registered on the SGPL Platform without the participation of a parent or lawful guardian as required above, we reserve the right to deny or suspend that Minor’s access and cancel any related registration.
2. DEFINITIONS
Applicable Law shall mean any and all: (i) laws, statutes, constitutions, treaties, rules, regulations, ordinances, codes, guidance; and (ii) all judicial, executive, legislative, administrative or military orders, directives, decrees, injunctions, judgments, permits, agreements, and other legal requirements, of, with, or adopted or imposed by any governmental authority, now or hereafter in effect, as amended from time to time.
Data Protection Law shall mean the Digital Personal Data Protection Act, 2023 and rules made thereunder, the Information Technology Act, 2000 and rules made thereunder, and any other Applicable Law governing the protection, security, or privacy of Personal Data.
Personal Data shall have the meaning given to it in the Privacy Policy, which governs the collection, use, storage, sharing, and protection of your Personal Data, including any health or medical information you disclose in connection with participation in an Event.
Products shall mean tickets to Devils Circuit events (including events held under any current or future sponsorship, co-branding, or title-partner arrangement) or any other current or future SGPL events, as well as merchandise related to the same, including its sub-brands, offered for sale to you on the Ticketing Platforms or, in the case of an Offline Transaction, directly by SGPL.
Event shall mean any sports, fitness, obstacle-course, or entertainment event organised, managed, or branded by SGPL, whether held in person or otherwise, that requires physical participation.
Services shall mean and include without limitation, organisation of sports events, providing sports entertainment and allied activities.
Intellectual Property Rights shall mean and include: (i) all rights, title, and interest under any statute or Applicable Law including patent rights, copyrights including moral rights, trademark and design rights, and any similar rights anywhere in the world; (ii) any licences, permissions and grants in connection therewith; (iii) applications for any of the foregoing; (iv) the right to obtain and hold registrations anywhere in the world; (v) extensions and renewals thereof; and (vi) causes of action, past, present or future, related thereto.
3. OUR SERVICES
The SGPL Platform enables Users to access information regarding our Services and Products, the SGPL Policies, and to communicate with us or raise support requests. SGPL does not itself sell, process, or fulfil any transaction for Products on the SGPL Platform. Save for offline transactions described below, all Products are listed and sold through third-party ticketing platforms such as www.getmybib.com and www.townscript.com (“Ticketing Platforms”).
SGPL is not an “e-commerce entity” in respect of any transaction for Products, does not process payments for Products, and assumes no obligations as a seller of record. Your purchase of any Product, and any related cancellation, refund, or exchange, is governed exclusively by the terms, conditions, and policies of the relevant Ticketing Platform, and by the terms of the Ticketing Platform’s own privacy policy in respect of any Personal Data you provide to it. We encourage you to read those policies carefully before purchasing any Product. SGPL shall have no liability for any act, omission, error, delay, or failure of a Ticketing Platform.
Certain Products, including corporate or bulk bookings, season passes, and on-ground or local merchandise, may be sold and paid for directly to SGPL offline, at the Venue or through direct invoicing, rather than through a Ticketing Platform (“Offline Transactions”). In respect of Offline Transactions, SGPL is the seller and payee of record, and any cancellation, refund, or exchange in connection with an Offline Transaction shall be governed by the cancellation and refund terms set out in the applicable Waiver Form or event registration documentation, and by Applicable Law governing such direct sales. Grievances relating to an Offline Transaction may be raised with SGPL’s Grievance Officer.
4. USE OF THE SGPL PLATFORM
SGPL and its group companies, subsidiaries, affiliates, officers, employees, agents, partners and licensors make no warranty that any errors on the SGPL Platform will be corrected within a specific time period. Any material downloaded or otherwise obtained through use of the SGPL Platform is accessed at your own discretion and risk.
You will use the SGPL Platform in accordance with Applicable Laws and will not use it in a way that infringes the rights of anyone else, including their Intellectual Property Rights, privacy, publicity, or contract rights.
You have a limited licence to access and use the SGPL Platform solely for the purpose of accessing information regarding our Services, communicating with us, or raising support requests, subject to these T&Cs. Without our prior written consent, you may not:
Where you correspond with, purchase from, or participate in a promotion of any advertiser, sponsor, or third party through the SGPL Platform, that transaction is solely between you and the third party, and SGPL has no liability in respect of it.
SGPL has no obligation to monitor your use of the SGPL Platform but may do so to ensure compliance with the SGPL Policies, comply with Applicable Law or a governmental or judicial order, detect or prevent fraud or security issues, respond to support requests, or protect the rights, property, or safety of SGPL, its Users, or the public. SGPL may cooperate with law enforcement authorities in relation to any violation of the SGPL Policies.
5. USE OF THE SGPL PLATFORM FROM OUTSIDE INDIA
Except where otherwise specified, the materials on the SGPL Platform are displayed solely to promote our Services available in India. Users who access the SGPL Platform from outside India are entirely responsible for compliance with the Applicable Laws of that jurisdiction. These T&Cs do not constitute, and may not be used in connection with, any promotional activity or solicitation in a jurisdiction where such activity is not authorised, or directed at any person to whom it is unlawful to promote or solicit.
6. SUBMISSIONS AND INTELLECTUAL PROPERTY LICENCE
This Clause governs any comments, blogs, feedback, suggestions, questions, ideas, artwork, images, or other content you submit, upload, or otherwise disclose to SGPL on or through the SGPL Platform or any SGPL social media channel, other than your Personal Data, which is governed exclusively by the Privacy Policy (collectively, “Submissions”).
By making a Submission, you grant SGPL a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable, and transferable licence to use, reproduce, modify, adapt, publish, distribute, publicly display, and create derivative works from that Submission, in any media now known or hereafter devised, for purposes connected with SGPL’s Services, marketing, and Platform operation.
You warrant that you own, or have all necessary rights and consents to grant the licence in, each Submission you make, that it does not infringe any third party’s rights, and that it is not defamatory, unlawful, or otherwise injurious to any person. You agree to indemnify SGPL and its affiliates against any third-party claim arising out of a breach of this warranty.
Submissions are treated as non-confidential and non-proprietary as between you and SGPL for the purposes of the licence above. SGPL may disclose your identity to a third party who claims that a Submission infringes their Intellectual Property Rights or right to privacy, where required or permitted by Applicable Law. SGPL is not responsible for the content or accuracy of any Submission made by you or any other User.
SGPL reserves the right, at any time and at its sole discretion, to remove, suspend, edit, or disable access to any Submission it considers objectionable, in violation of these T&Cs, or otherwise harmful to the SGPL Platform, including upon receipt of a third-party or governmental complaint.
If a Submission provided by you is found to be false or inaccurate, SGPL may restrict your use of the Services without prior notice.
7. SOCIAL NETWORKING SITES
Any Submissions you make on a third-party website or page, such as Facebook, Instagram, X, or YouTube or any other platform, are governed by the terms of use and policies of that platform. You should read those terms before posting, and any use of such platforms is entirely at your own risk. Content posted on any third-party platform does not necessarily reflect SGPL’s views and SGPL is not responsible for it.
8. INTELLECTUAL PROPERTY OF SGPL
All rights, including copyright and other Intellectual Property Rights, in and to the SGPL Platform, Products, and Services are owned by or licensed to SGPL. We grant you a non-exclusive, limited, royalty-free, and revocable licence to use the SGPL Platform to access information regarding our Services and Products. This grants you no rights in our Intellectual Property Rights or those of any third party.
All trade names associated with SGPL and logos denoted with ™ or ® are trademarks or registered trademarks of SGPL or its affiliates. These marks may not be used in connection with any product or service that is not an SGPL Product or Service, without SGPL’s prior written consent.
9. PERSONAL DATA
Any Personal Data you provide to us, or that we collect through your use of the SGPL Platform or participation in an Event, is collected, used, stored, shared, and protected strictly in accordance with, and only to the extent you have consented under, the Privacy Policy. The Privacy Policy governs all such processing, including of any health or medical information disclosed in an event registration or waiver form.
10. CONFIDENTIALITY
User Content. As set out in Clause 6, Submissions are treated as non-confidential and non-proprietary for the purposes of the licence granted to SGPL.
Your Confidentiality Obligations. During your use of the SGPL Platform, you may receive information relating to SGPL or its Services that is not known to the general public (“Confidential Information”). You agree that: (a) Confidential Information remains SGPL’s exclusive property; (b) you will use it only as reasonably necessary for your participation in our Services; (c) you will not disclose it to any other person; and (d) you will take reasonable measures to protect it. You may not issue a press release, make a public statement, or use SGPL’s name, trademarks, or logo in promotional material without SGPL’s prior written permission.
11. USER WARRANTIES AND PROHIBITED CONTENT
You are prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, or sharing on or through the SGPL Platform any information that:
SGPL reserves the right, without prior notice, to remove, suspend, edit, or disable access to any content it considers, in its reasonable discretion, to fall within the above categories, and to investigate and pursue all available legal remedies, including cooperating with law enforcement authorities.
12. GRIEVANCE REDRESSAL AND INTERMEDIARY COMPLIANCE
Where the SGPL Platform hosts Submissions or other User-generated content, SGPL acts as an intermediary and follows the due-diligence requirements of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
SGPL will acknowledge a complaint concerning content that violates Clause 11 within 24 (twenty-four) hours of receipt, and will endeavour to resolve or dispose of such complaint within 15 (fifteen) days of receipt. Where SGPL receives an order from a court of competent jurisdiction or an appropriate government authority requiring removal or disabling of access to any content, SGPL will act upon such order within 36 (thirty-six) hours.

The Grievance Officer will acknowledge receipt of a grievance within 48 (forty-eight) hours and endeavour to redress it within 30 (thirty) days to the extent applicable to SGPL’s activities. By lodging a complaint or grievance, You agree to provide complete support to the Grievance Officer and such reasonable information as may be sought by them from You.
13. EVENT PARTICIPATION, RISK ACKNOWLEDGMENT AND WAIVER
Participation in an Event is voluntary and involves inherent physical risk, including the risk of injury. Before participating in an Event, you (or, where you are a Minor, your parent or lawful guardian) will be required to execute a separate event registration and waiver form (“Waiver Form”), which forms part of the SGPL Policies and is incorporated into these T&Cs by reference. In the event of any inconsistency between these T&Cs and a Waiver Form on a matter specific to an Event, the Waiver Form shall prevail in respect of that Event only.
By registering for an Event, you confirm that you are medically fit to participate, that any health or medical information you disclose is true and complete, and that such information will be used strictly in accordance with the Privacy Policy, including to enable our on-ground medical and safety personnel to respond appropriately in an emergency.
To the fullest extent permitted by Applicable Law, SGPL’s liability for injury, loss, or damage arising out of or in connection with your participation in an Event is limited as set out in Clause 15 (Limitation of Liability).
14. DISCLAIMER OF WARRANTIES AND ACCURACY OF CONTENT
We try to ensure that information on the SGPL Platform is correct at the time of inclusion, but we do not guarantee its accuracy, completeness, or currency, and disclaim all warranties in this respect to the extent permitted by Applicable Law. Views expressed in User-generated content are those of the relevant User and do not represent SGPL’s views. Any use of the SGPL Platform or its content is at your own risk. Nothing on the SGPL Platform constitutes an invitation to invest in SGPL or its affiliates, or a recommendation to use any Product, process, or equipment. The SGPL Platform is provided on an “as is” and “where is” basis, without warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by Applicable Law.
15. LIMITATION OF LIABILITY
Our aggregate liability arising out of or in connection with this Policy, whether in contract, tort or otherwise, is limited to the fees, if any, actually paid by You for the Services in connection with which the claim arises. In no event will We be liable for indirect, incidental, consequential, special or punitive damages, including loss of profits, data or goodwill, arising out of or in connection with this Policy or Our processing of Your Personal Data, even if We have been advised of the possibility of such damages.
Subject to Clauses 13 and 15, SGPL’s aggregate liability arising out of or in connection with your use of the SGPL Platform, or a Product or Service, whether in contract, tort, or otherwise, shall not exceed the amount of fees actually paid by you for the specific Product or Service giving rise to the claim.
SGPL shall not, under any circumstance, be liable for any incidental, special, or consequential damages, including loss of profits or revenue.
We are not responsible for, and disclaim liability in connection with, the security practices, content or privacy policies of a Third-Party Site or a third-party service provider engaged by You independently of SGPL, including where that third party has independently obtained Your Personal Data.
16. INDEMNIFICATION
You agree to indemnify, defend and hold harmless SGPL, its officers, directors, employees and agents from and against claims, losses, liabilities, damages, costs and expenses (including legal fees) arising out of or in connection with: (a) Your breach of this Policy; (b) Your provision of inaccurate, incomplete or fraudulent information to Us; (c) Your violation of Applicable Law; or (d) Your infringement of a third party’s rights, including in connection with a Post or Event Media featuring a third party that You submit to Us. Where the User is a minor, this indemnity is given by, and is enforceable against, the parent or lawful guardian who accepted this Policy and any applicable Waiver Form on the minor’s behalf, and not against the minor personally.
17. COMMUNICATIONS AND MARKETING CONSENT
Where you have provided consent at the point of collection, we will send you service, transactional, and account-related communications by SMS, WhatsApp, call, email, or other electronic means to your registered contact details.
We will send you promotional or marketing communications only where you have given separate, specific, opt-in consent to receive them.
You may withdraw your consent to promotional communications, or unsubscribe from them, at any time, by following the instructions in such communications or by contacting us at info@devilscircuit.com. Withdrawal of consent will not affect transactional or service communications necessary for us to provide the Services to you.
18. OTHER LEGAL NOTICES
There may be legal notices in other areas of the SGPL Platform relating to your use of it, all of which, together with the SGPL Policies, govern your use of the SGPL Platform.
19. MODIFICATION OF THESE T&Cs
We may update, replace, or amend these T&Cs from time to time to comply with Applicable Law or to reflect our changing business requirements. Updates will be posted on the SGPL Platform and, unless stated otherwise, take effect immediately upon posting. We encourage you to review these T&Cs periodically. Your relationship with the SGPL Platform is governed by the most current version published on the SGPL Platform.
20. ASSIGNMENT AND THIRD-PARTY RIGHTS
You may not assign or sub-contract any right or obligation under these T&Cs without our prior written consent. We may assign, transfer, or sub-contract any of our rights or obligations under these T&Cs to any third party at our discretion, including in connection with a merger, acquisition, or sale of assets, provided the assignee remains bound by these T&Cs. Only you and SGPL may enforce these T&Cs; no third party has any right to do so.
21. NO WAIVER OF RIGHTS
No relaxation or delay by SGPL in exercising any right or remedy under these T&Cs operates as a waiver of that right or remedy, nor affects SGPL’s ability to subsequently exercise it. Any waiver by SGPL must be in writing.
22. SEVERABILITY
Each section of these T&Cs shall be interpreted, wherever possible, to be valid under Applicable Law. If any provision is found illegal, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be ineffective only to the extent of such invalidity, without affecting the remainder of these T&Cs, which shall remain in full force and effect.
23. ENTIRE AGREEMENT
The SGPL Policies, including these T&Cs, the Privacy Policy, and any applicable Waiver Form, set out the entire agreement between you and SGPL in relation to your use of the SGPL Platform and participation in our Services, and supersede any prior terms, conditions, or representations, to the fullest extent permitted by Applicable Law.
24. GOVERNING LAW AND JURISDICTION
These T&Cs shall be governed by and construed in accordance with the laws of India, and any dispute arising out of or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the courts at Gurugram, Haryana.
25. NOTICES
All notices and communications shall be in writing, in English, and deemed given if delivered personally, by commercial courier, by registered or certified mail (return receipt requested), or by email, to:

26. FORCE MAJEURE
SGPL shall not be responsible for any delay, loss, damage, or failure to comply with its obligations under these T&Cs to the extent such failure arises from a cause beyond SGPL’s reasonable control (“Force Majeure Event”), including but not limited to pandemic, epidemic, fire, flood, explosion, act of God, civil commotion, strike, lock-out, industrial action, riot, insurrection, war, act of government, cyberattack, or power failure.
27. INTERPRETATION
Headings, subheadings, and titles are for information only and do not form part of the operative provisions of these T&Cs. Words denoting the singular include the plural, and words denoting any gender include all genders. The words “include” and “including” are to be construed without limitation.
